Welcome to Crypto Whailes. By accessing or using our website and services (the “Services”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Services.

1. Eligibility & Accounts

You must be legally permitted to use the Services in your jurisdiction and at least 18 years old. You are solely responsible for your account, your actions, your trades, and for keeping your login and API keys secure. All activity under your account is your responsibility, whether authorized or not.

2. Subscriptions & Access

Some features require a paid subscription. Prices, plans, and limits are displayed in the app and may change at any time. All sales are final and non-refundable. We may suspend or revoke access for any misuse or violation of these Terms.

2.1 Hobby / Non‑Commercial Nature

The Services are provided on a best‑effort basis by an individual operator. There are no service level commitments, uptime guarantees, or ongoing support obligations. You acknowledge that features can change rapidly and the Service may be paused or shut down at the operator’s discretion.

3. Trading Risk Disclaimer

Trading digital assets is inherently risky and may result in complete loss of funds. Crypto Whailes does not provide investment, financial, tax, or legal advice. All trades and strategies are your own decision and at your sole risk. Past results do not guarantee future outcomes.

4. API Keys & Security

If you connect exchange API keys, you accept full responsibility for securing them. We strongly recommend exchange-side security (e.g., IP whitelisting, withdrawal restrictions). Crypto Whailes is not responsible for any loss, theft, or misuse of your keys.

5. Acceptable Use

You may not misuse the Services, attempt unauthorized access, reverse engineer, overload, or use the Services in violation of law or exchange rules. Accounts may be suspended or terminated immediately for abuse.

6. Referrals & Payments

We may provide referral programs at our discretion. Participation does not guarantee payment. Referral amounts, rules, and eligibility may be changed or withdrawn at any time. We reserve the right to withhold payments, restrict users, or permanently ban accounts if suspicious, abusive, or fraudulent activity is suspected. We are under no obligation to pay referral rewards. All associated fees and costs are the sole responsibility of the user.

7. Intellectual Property

The Services, content, software, and UI are owned by us or our licensors and protected by law. You are granted a limited, non-transferable license to use the Services. No other rights are granted.

8. Disclaimers

The Services are provided “as is” and “as available” with no warranties of any kind. We do not guarantee uptime, accuracy, or suitability for any purpose. You assume all risk in using the Services.

9. Limitation of Liability

To the fullest extent permitted by law, Crypto Whailes is not liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to trading losses, data loss, or loss of profits. Your only remedy is to stop using the Services.

10. Changes

We may update these Terms at any time, and—given the hobby nature of the project—changes may occur more frequently than a commercial service. Changes take effect immediately upon posting unless otherwise stated. Your continued use after updates are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be resolved exclusively in South African courts.
